1. Service Description

Proven Success Inc. ("we", "us") provides RevSharrk, an AI-powered business consulting and analytics platform for small business owners across boutique fitness, pet care, entertainment venues, and med care industries. RevSharrk offers metric tracking, trend analysis, and AI-generated action recommendations to help owners improve business performance.

2. Nature of Guidance

RevSharrk provides AI-powered business consulting based on proven revenue optimization frameworks, applied to your specific business data. Recommendations are directional guidance informed by your metrics and goals, not a guarantee of specific outcomes. AI systems, including RevSharrk, can make errors, produce outdated analysis, or fail to account for factors specific to your business. You should independently verify any material business decision with qualified professional advisors before acting on it. RevSharrk does not provide licensed legal, tax, or investment advice.

3. Data Processing

To provide its services, RevSharrk processes the business information you share (revenue, costs, customer data, and conversation history) using third-party AI infrastructure providers, including Groq, Inc., Microsoft Azure AI, and Anthropic PBC. By using RevSharrk, you consent to this processing. We do not sell your data to third parties.

If you are matched with a human RevSharrk business consultant, that consultant will have access to the business data described above — including your metrics, goals, and AI-recommended actions — solely to provide consulting services to you. This access is limited to consultants you are actively matched with, ends automatically if that match ends, and is subject to confidentiality obligations in the consultant's agreement with RevSharrk. A matched consultant may use Company-approved AI tools to assist in analyzing your business data as part of delivering that consulting service.

4. Eligibility

RevSharrk is intended for business owners and operators aged 18 or older. By using the service you confirm you meet this requirement.

5. Subscriptions and Billing

Paid plans are billed on a recurring monthly or annual basis and renew automatically until cancelled. You may cancel at any time from your account settings. Cancellation takes effect at the end of the current billing period. Payments are processed securely by Stripe. We do not store your card details.

The Pro plan includes a 14-day free trial: your card is authorized at signup but not charged until the trial ends. Cancel any time during those 14 days from your account settings and you will not be charged. This is a no-cost trial period, not a guarantee of business results or outcomes.

RevSharrk Max begins with a free business audit, delivered through your initial conversation with RevSharrk, before any ongoing engagement starts. Max does not include a results-based refund guarantee; the general cancellation terms above apply (cancel anytime, effective at the end of your current billing period, no refund for time already billed). Customers who enroll in Max at a discounted introductory rate keep that rate for the life of their engagement, even if list pricing changes for new customers.

6. Your Responsibilities

You agree to provide accurate business information and to use RevSharrk only for lawful purposes. You are responsible for maintaining the confidentiality of your account credentials.

7. Limitation of Liability

To the fullest extent permitted by law, Proven Success Inc. shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of RevSharrk or reliance on its recommendations, including but not limited to lost profits, lost revenue, or business interruption. In any case, our total aggregate liability to you for direct damages shall not exceed the fees you have paid to us in the twelve (12) months immediately preceding the claim.

8. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles.

9. Changes to Terms

We may update these Terms from time to time. Continued use of the service after changes are posted constitutes acceptance of the updated Terms.
